1. Introduction
These Terms & Conditions govern all bookings made with 3ness Ltd ("3ness"). They define the responsibilities of 3ness, its suppliers, and its participants, and demonstrate the company's commitment to safety, governance, and regulatory compliance.

2. Scope of Services
3ness operates as an event organiser and package organiser under the Package Travel and Linked Travel Arrangements Regulations 2018.
3ness:
- Designs and coordinates fitness and wellness events
- Engages independent third-party suppliers
- Ensures suppliers hold appropriate insurance
- Conducts due diligence on venues and instructors
- Implements structured risk-management processes
3ness does not own or operate hotels, venues, transport services, or fitness instruction businesses.
3. Independent Third-Party Suppliers
To ensure clarity of liability and risk allocation:
3.1 Supplier Independence
All accommodation, fitness instruction, workshops, activities, transport and ancillary services are delivered by independent third-party suppliers.
3.2 Supplier Insurance
3ness obtains and verifies evidence of:
- Public Liability insurance
- Professional Indemnity insurance (where applicable)
- Employer's Liability insurance (where applicable)
3.3 Supplier Indemnities
3ness obtains contractual indemnities confirming that suppliers:
- Are responsible for their own acts, omissions and negligence
- Comply with local safety regulations
- Provide and maintain safe equipment
- Are responsible for their staff and subcontractors
3.4 Liability for Suppliers
3ness is not liable for:
- Supplier negligence
- Supplier insolvency
- Supplier failure to deliver contracted services
- Acts or omissions of instructors, venues, or transport providers
This allocation of responsibility is communicated clearly to participants.
4. Participant Responsibilities & Risk Acceptance
4.1 Fitness & Medical Suitability
Participants confirm they:
- Are medically fit to participate
- Have disclosed relevant medical conditions
- Understand the physical nature of fitness activities
4.2 Compliance with Safety Instructions
Participants must:
- Follow all instructor guidance
- Use equipment responsibly
- Act within their personal fitness limits
4.3 Assumption of Risk
Participants acknowledge that fitness activities carry inherent risks and accept responsibility for:
- Injuries arising from failure to follow instructions
- Misuse of equipment
- Participation beyond their ability
- Pre-existing medical conditions
4.4 Behaviour
3ness reserves the right to remove participants who pose a safety risk.
5. Booking, Payment & Financial Controls
5.1 Booking Confirmation
A booking is confirmed only when:
- Payment is received
- Written confirmation is issued
- The participant agrees to these Terms
5.2 Deposits
Deposits are non-refundable.
5.3 Payment Deadlines
Failure to meet payment deadlines may result in cancellation without refund.
5.4 Financial Protection
Where required, 3ness complies with Package Travel Regulations financial protection requirements.
6. Cancellations by Participants
Cancellation charges reflect supplier commitments and mitigate financial exposure.
UK Events
- >60 days: Loss of deposit
- 31-60 days: 50%
- 0-30 days: 100%
International Events
- >90 days: Loss of deposit
- 61-90 days: 50%
- 0-60 days: 100%
No refunds for:
- Missed activities
- Travel delays
- Early departure
- Missed payment deadlines
7. Cancellations or Changes by 3ness
3ness may amend or cancel events due to:
- Supplier failure
- Venue closure
- Insufficient numbers
- Safety concerns
- Force majeure
Where possible, 3ness will offer:
- Alternative dates
- Alternative events
- Credit notes
- Refunds limited to recoverable supplier costs
3ness is not liable for consequential losses.
8. Force Majeure
Events outside 3ness' control include:
- Natural disasters
- Fire, flood, extreme weather
- Pandemics or epidemics
- Government restrictions
- Venue closure
- Supplier insolvency
- Strikes or industrial action
- Civil commotion or terrorism
- Transport disruption
Refunds may be limited to recoverable costs.
9. Travel Arrangements
Unless explicitly stated, participants are responsible for arranging their own travel.
3ness is not liable for:
- Flight cancellations
- Missed connections
- Travel delays
- Lost luggage
No refunds for missed activities due to travel issues.
10. Personal Property
Participants are responsible for their belongings. 3ness is not liable for loss, theft or damage unless caused by 3ness' negligence.
11. Limitation of Liability
Nothing excludes liability for death or personal injury caused by negligence.
Subject to this:
- 3ness' total liability is capped at the amount paid for the booking
- 3ness is not liable for indirect or consequential losses
- 3ness is not liable for supplier negligence
- 3ness is not liable for participant-caused injuries
This clause aligns with insurer expectations and reduces exposure.
12. Insurance Requirements
Participants are strongly advised to obtain:
- Travel insurance
- Medical insurance
- Cancellation insurance
3ness does not insure participants.
13. Complaints Procedure
Participants must notify 3ness of issues promptly. Formal complaints must be submitted within 14 days of the event.
14. Data Protection
3ness processes personal data in accordance with its Privacy Policy.
15. Governing Law
These Terms are governed by the laws of England & Wales. Disputes are subject to the exclusive jurisdiction of the English courts.
16. Acceptance of Terms
By booking or attending a 3ness event, participants confirm acceptance of these Terms.
